Revised Code of Conduct from 16/08/2021

A revised Code of Conduct (Code) for Property Factors was approved by the Scottish Parliament earlier this year We provided a single date for implementation that was intended to allow time for planning and action to make the changes needed as a result of the revised Code. This is a reminder that there is now one month to go until the revised Code comes into force on 16 August 2021. We published a final version of the revised Code for Property Factors on 14 July 2021 and this can be found on the Scottish Government website at: https://www.gov.scot/isbn/9781802011388 The text / content of this version is exactly the same as the version approved by Parliament in March 2021 with only a formatting change to add numbering to the overarching standards of practice on pages 8-9. The change is a formatting matter which does not in any way alter the substance of the code. It will simply assist the First-tier Tribunal for Scotland (Housing and Property Chamber) (Tribunal), homeowners and property factors in referring to specific overarching standards of practice. The overarching standards of practice are now numbered, rather than bulleted, in the format of OSP1, OSP2. OSP3 etc. The order that brings the revised Code into force includes provision for cases that are going through the tribunal at the time of implementation. The revised Code will apply to any application made to the Tribunal after the new Code comes in to force. We believe that the revisions have clarified and strengthened the Code and will ensure that property factors work to a consistent standard and homeowners are clear on what they can expect.
