Revised Code of Conduct taking effect from 16/8/21

Following the conclusion of our consultation and engagement, a revised Code of Conduct for property factors was laid before the Scottish Parliament on 15th January 2021 and published on the Scottish Government website on 18th January 2021, as required by the Property Factors (Scotland) Act 2011. You can find the revised Code at: https://www.gov.scot/publications/code-of-conduct-for-property-factors-2021/ We can confirm also that the final Order to bring into force a revised Code was laid before the Parliament on 19th January 2021. The revised Code will come into force on 16th August 2021, subject to approval from the Scottish Parliament. Following engagement, we have provided a single date for implementation that is intended to allow time for planning and action to make the changes needed as a result of the revised Code. In addition, the order includes provision for cases that are going through the tribunal at the time of implementation. The revised Code will apply to any application made after the new Code comes in to force. We believe that the revisions have clarified and strengthened the Code and will ensure that property factors work to a consistent standard and homeowners are clear on what they can expect. We have decided not to lay a modification order on the definition of a property factor at this stage and that work on this should be incorporated in to wider policy development on property factors going forward.
