Refusal to the register of property factors

The following property factor was refused entry to the register of property factors on 3 September 2020 under section 4(5) of the Property Factors (Scotland) Act 2011:

This means the relevant date under section 9(2) of the Property Factors (Scotland) Act 2011 (effect of refusal) is 25 September 2020. Accordingly, after 25 September 2020
• No costs incurred by the property factor in respect of work instructed after 25 September 2020 are recoverable;
• No charge imposed by the property factor which relates to a period after 25 September 2020 is recoverable;
• Homeowners may appoint a new property factor (or decide to manage their properties without appointing a property factor) in accordance with the procedures made in relation to such decisions in their title deeds or, as the case may be, the Tenement Management Scheme; and
• The property factor may not lodge a notice of potential liability for costs under section 13(1) of the Tenements (Scotland) Act 2004 (asp 11) in respect of work instructed after 25 September 2020.
A public notice informing of the refusal will appear in the Edinburgh Evening News on 13 October 2020.
