APEX PROPERTY FACTOR LIMITED

The Scottish Ministers hereby give public notice of removal of the property factor named below from the Property Factor Register under section 8(1) of the Property Factors (Scotland) Act 2011 (the “Act”). Apex Property Factor Limited 46 Eastside Kirkintilloch G66 1QH The date of removal was 10th April 2019. Apex Property Factor Limited appealed to the sheriff against the decision by the Scottish Ministers under section 8(1) of the Property Factors (Scotland) Act 2011 to remove them from the Register from 10th April 2019. This appeal was unsuccessful. As such the relevant date under section 9(2) of the Property Factors (Scotland) Act 2011 is 10th January 2020. Accordingly after 10th January 2020: • No costs incurred by the property factor in respect of work instructed after 10th January 2020 are recoverable; • No charge imposed by the property factor which relates to a period after 10th January 2020 is recoverable; • Homeowners may appoint new property factors (or decide to manage their properties without appointing a property factor) in accordance with the procedures made in relation to such decisions in their title deeds or, as the case may be, the Tenement Management Scheme; and • The property factor may not lodge a notice of potential liability for costs under section 13(1) of the Tenements (Scotland) Act 2004 (asp 11) in respect of work instructed after 10th January 2020 • A Public notice confirming the removal will appear in the Airdrie & Coatbridge Advertiser, Clydebank Post, Irvine Herald, Kirkintilloch Herald, Kilmarnock Standard, Motherwell Times, Paisley Daily Express, Cumbernauld News and Glasgow Herald on 22nd January 2020 and in the Hamilton Advertiser on 23rd January 2020.
